I’ve run into a problem while filing my Form 109. I’m currently in the new two-year training scheme, and I have already completed one year of articleship. However, when I submitted Form 109 to terminate my articleship, I mistakenly selected the option “within one year” instead of “leaving for industrial training,” even though I filled in the correct dates for my completed year.
Now, when I tried to file Form 104 for my industrial training, it was rejected by the RO due to my earlier incorrect reason. I reached out for help by raising a ticket and calling the SSP helpline. They advised me to take up articleship for 2-3 days and then correctly terminate it with the right reason.
Unfortunately, I’ve spoken to two CAs about this, and both have declined to assist me, fearing it might lead to complications for them. I’m in a bit of a bind here because I’ve already secured a fantastic placement for my industrial training, and have completed a month of it. If anyone has any advice or can help, I would greatly appreciate it!

It sounds like you’re in a tough situation, but there are a few steps you can consider taking to resolve this issue:
Contact the Institute: Since you’ve already raised a ticket and called the SSP helpline, consider reaching out to the relevant department of the Institute of Chartered Accountants (or your governing body). Explain your situation clearly and ask if they can guide you on the correct procedure to amend your filing error.
Written Communication: Send a formal letter or email explaining your mistake and requesting guidance on how to proceed. Sometimes having it in writing can help expedite a response.
Consult Another CA: If the two CAs you’ve spoken to are hesitant, try seeking a third opinion. Look for a CA who specializes in student articleship issues or has experience with the filing processes. They might be more familiar with the process and able to provide guidance.
Discuss with Your Placement: Since you have a placement for industrial training, consider discussing your situation with the company or the person in charge of your placement. They may have dealt with similar issues before and might offer assistance or advice.
Temporary Articleship: If you decide to go through with the suggestion of taking a brief articleship to correctly file your termination, ensure that you document everything properly and confirm that this is acceptable with the Institute first. It’s essential to keep everything compliant with regulations to avoid future issues.
Document Everything: Keep a detailed record of all communication and steps taken. This could be helpful if you need to provide evidence of your efforts to resolve the issue.
Remember to remain calm and patient throughout the process. Errors in paperwork can often be rectified, especially if you take proactive steps to correct them. Good luck!
